1) Acceptance of Terms

By accessing or using elevynlabs.com (the “Website”) and purchasing products from our online store (the “Store”), you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree, do not use the Website or purchase from the Store. We may update these Terms at any time by posting a revised version. Continued use constitutes acceptance.

2) Age & Supervision

  • The Website and Store are not intended for individuals under 18.
  • Purchases may only be made by adults (18+).
  • If a minor (under 18) visits the Website, they must do so with adult supervision.
  • By placing an order, you represent you are 18+ and legally able to enter into this agreement.

3) Products; No Medical Advice

We sell skincare and dietary supplement products. Information on the Website (including product descriptions, articles, tips, or FAQs) is for informational purposes only, is not medical advice, and is not a substitute for professional medical care.

  • Always consult a physician before using any new skincare or supplement, especially if you are pregnant/nursing, have a medical condition, take medication, or have known allergies/sensitivities.
  • Patch-test skincare prior to full use. Discontinue if irritation occurs.
  • FDA notice (supplements): Statements on the Website regarding supplements have not been evaluated by the Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.

4) Accounts & Security

You may create an account to expedite checkout. You are responsible for your account credentials and all activities under your account. Notify us of any unauthorized access. We may suspend or terminate accounts for suspected misuse or violations.

5) Orders, Pricing, & Availability

  • Submitting an order is an offer to buy; we may accept or decline in our discretion (e.g., due to availability, suspected fraud, pricing or listing errors).
  • Prices, promotions, and availability may change without notice.
  • If we cancel all or part of an order after charging you, we’ll refund the cancelled portion.

6) Payment; Third-Party Processors

Payments are processed by third-party payment processors. By paying, you agree to their terms and authorize them to charge your selected payment method for the order total, including shipping, taxes, and applicable fees. We do not store full payment card details.

7) Shipping, Risk of Loss, Title

  • We may use third-party vendors/fulfillment partners to pick, pack, and ship your order.
  • Title and risk of loss pass to you upon delivery to the carrier.
  • Shipping times are estimates and not guarantees; carrier delays are outside our control.
  • For international shipments, you are responsible for customs, duties, VAT/GST, import taxes, brokerage fees, and compliance with import laws in your location.

8) Returns & Refunds

Please see our Returns/Refunds Policy (posted on the Website) for eligibility, timelines, and instructions. For hygiene and safety, some items (e.g., opened skincare or supplements) may be non-returnable unless defective/damaged on arrival.

9) Ingredients, Allergens & Sensitivities

We aim to list ingredient information accurately as supplied by manufacturers. You are responsible for reviewing ingredients and avoiding products that may trigger allergies or sensitivities. Stop use and seek medical advice if adverse reactions occur.

10) User Conduct & Prohibited Uses

You agree not to:

  • Violate any law, infringe IP or privacy rights, or submit unlawful, harmful, or deceptive content.
  • Interfere with site security; deploy malware, scraping, or automated bots without permission.
  • Misrepresent your identity or attempt unauthorized access.
     We may suspend or terminate access for violations.

11) Intellectual Property

All content on the Website (text, graphics, logos, images, videos, product copy, and compilations) is owned by or licensed to Elevyn Labs and protected by intellectual property laws. You may not copy, distribute, modify, or create derivative works without our prior written consent, except as permitted by law.

12) Health & Regulatory Compliance

You are responsible for ensuring that purchasing, importing, and using our products comply with the laws and regulations in your jurisdiction. We make no representation that products or materials are appropriate or available for use outside the United States.

13) Third-Party Services & Vendors

We rely on third-party vendors (e.g., payment processors, fulfillment and shipping partners, email and analytics providers). Your data may be processed by these vendors solely to perform contracted services. Their services are subject to their own terms and privacy practices.

14) Disclaimers

  • AS IS / AS AVAILABLE. The Website, Store, and all content are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
  • We do not guarantee that any product will achieve any particular health, cosmetic, or wellness outcome.

15) Limitation of Liability

To the maximum extent permitted by law, Elevyn Labs LLC, its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business interruption, arising out of or related to your use of the Website, Store, or products, even if advised of the possibility.
In no event will our aggregate liability exceed the greater of USD $500 or the amount you paid to us for the product(s) giving rise to the claim in the six (6) months preceding the claim.

16) Indemnification

You agree to indemnify, defend, and hold harmless Elevyn Labs LLC and its personnel from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Website/Store or products in violation of these Terms or law; (b) your breach of any representation; or (c) your content or misuse.

If you access the Website from outside the U.S., you do so at your own risk and are responsible for compliance with local laws. You consent to the processing of your information in accordance with our Privacy Policy.

19) Dispute Resolution; No Class Actions

Arbitration. Except where prohibited by law, any dispute or claim arising out of or relating to these Terms, the Website, Store, or products will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

  • Venue & Law. The seat of arbitration is Delaware, USA; one arbitrator; English language.
  • Class Action Waiver. Disputes will be resolved only on an individual basis; class, consolidated, or representative actions are not permitted.
  • Injunctive/Emergency Relief. Either party may seek temporary injunctive relief in a court of competent jurisdiction to protect its rights pending arbitration.

20) Governing Law; Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws. Subject to the arbitration clause, the exclusive venue for any permitted court action is in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

21) Severability; Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.

22) Changes; Availability

We may modify, suspend, or discontinue any part of the Website or Store at any time without notice. We are not liable for any modification, suspension, or discontinuance.

23) Entire Agreement

These Terms, together with the Privacy Policy and any policy referenced on the Website, constitute the entire agreement between you and Elevyn Labs LLC regarding the Website, Store, and products, and supersede all prior understandings.
